Terms of Use
for the “PayCycle Community” Blog
We expect you, as a “PayCycle Community” reader and contributor, to offer quality comments and conversations that bring value to all of our readers, and to have fun while doing so. By viewing, subscribing to, or contributing to PayCycle Community you agree to be bound by the following Terms of Use, which form a legal agreement between you and PayCycle.
Setting the Tone. To ensure our blog is buzzing with quality conversation and to maintain an environment of respect and integrity for our bloggers and readers, we reserve the right to remove inappropriate or off-topic comments. We are committed to making sure various viewpoints are represented in PayCycle Community conversations. So as a commenter you must:
- Be respectful – do not insult, threaten, or abuse; do not use profanity, deception, or off-color remarks (or jokes); and do not post harmful, illegal, or infringing content (such as another’s copyrighted work);
- Be honest and engage –offer accurate insights and informed responses when topics appeal to you;
- Stay relevant – offer comments and feedback that contribute to quality conversation about the topic being discussed;
- Not impersonate or misrepresent your affiliation with any person or entity;
- Not post any advertising, promotional materials, or spam;
- Be smart – do not reveal personal information about yourself, bloggers, or fellow commenters. PayCycle will never ask for your password or personal information via the blog or email.
Viewpoint. PayCycle and the PayCycle community appreciate your feedback, participation, and point-of-view. Blog entries and responsive comments do not necessarily reflect the position or opinion of PayCycle, even if posted by a PayCycle employee. Comments are solely the responsibility of our users, and although PayCycle reserves the right to moderate the blog to ensure credible and appropriate content is posted, we are not responsible for the content that users post or how the content is interpreted by readers. Post your comments carefully—you will not have the ability to retract or edit any submissions.
Not Legal or Financial Advice. Nothing on the PayCycle Community blog should be construed as legal, regulatory, or financial advice, whether posted by PayCycle employees or others. Do not rely on any information on PayCycle Community blog as a substitute for obtaining legal advice from an attorney licensed in your jurisdiction.
License to PayCycle. PayCycle does not claim ownership rights in your content. But by submitting or posting any content to the blog, you hereby grant PayCycle a non-exclusive, worldwide, royalty-free, sublicensable, perpetual, and irrevocable right and license to reproduce, modify, prepare derivative works of, perform, display, publish, distribute, transmit, make, use, and sell such content and any inventions therein in any form, medium, or technology now known or later developed, including, without limitation, on the Internet and in connection with the promotion and marketing of PayCycle’s business.
Linking; No Copying. You may link to this PayCycle Community blog, but you agree not to copy, modify, or distribute any of the content found here.
Termination. Without limiting its other remedies, for violation or suspected violation of these Terms of Use, PayCycle may immediately terminate or suspend your access to the PayCycle Community blog or remove any material you posted. We also reserve the right to end-of-life any comment, thread, or blog at our sole discretion, at any time, and for any reason.
Law Enforcement. PayCycle may notify law enforcement, without notice to you, if PayCycle suspects or determines, in its own discretion, that you have engaged in actions relating to or in the course of using the PayCycle Community blog that may be illegal or cause liability, harm, embarrassment, harassment, or disruption to PayCycle or its users. We reserve the right to fully cooperate with any law enforcement authorities or court orders requesting or directing us to disclose the identity of anyone posting, publishing, or otherwise making available any content believed to violate these Terms of Use.
No Warranty. Please do not take any of these terms—or any blog entry or comment—as a warranty about the blog or any PayCycle products or services. PayCycle disclaims all warranties, including any about the accuracy, availability, timeliness, or completeness of any blog, and any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability. In no event will PayCycle or its bloggers be liable to you for any incidental, special, punitive, or consequential damages in connection with the PayCycle Community blog, whether or not the damages are foreseeable or PayCycle has been advised of the possibility of such damages. In no event will PayCycle’s cumulative liability to you in connection with the PayCycle Community blog exceed $10.
General. The failure of a party to enforce any right or provision of these Terms of Use will not be deemed a waiver of that right or provision. PayCycle may assign these Terms of Use or any rights hereunder without your consent. These Terms of Use will be governed by and interpreted in accordance with the laws of the State of California excluding that body of law pertaining to conflict of laws. Any legal proceeding arising under these Terms of Use will be brought exclusively in courts located in California and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.
